NKDigitalArt Terms of Use for NKDA artwork
1. Generally No image, composition or product may be sold, bartered or used for profit or "break even" endeavors in any way OR used in association with any site "requiring" membership fees to join.
2. All images and tube creations MUST be credited in the following manner:

(a) on all of your digital creations. This includes, but is not limited to tags, stationary, web sets, MySpace pages or other social network pages, personal websites, other website layouts or skins, banners and any other digital means of design.
(b) You MAY put tubed by____ or tagged by_____ and your watermark on your tags however you MAY NOT put a copyright symbol next to your name.
(c) You MAY add group links along with all other necessary copyright information to the BOTTOM and or FOOTERS of stationary you create.
(d) You MAY add credit for scrap kits and backgrounds in the following manner: scrap kit by______ , render by_______ or background by_________.
The above outlined copyright display terms apply to creations made or painted by KatNKDA or NamonNKDA, ©cottonbelle tubes (handpainted) and ©Pin-A-Licious Toons This includes, but is not limited to tags, stationary, web sets, MySpace pages or other social network pages, personal websites, other website layouts or skins, banners and any other digital means of design.
3. Group Banners MAY contain your group URL as long as all other copyright credits are present
4. You MAY tube images yourself.
5. You MAY NOT receive monetary compensation for tubes or images, tags, stationary or web sets made with material from NKDigitalArt unless otherwise stated on the download page
6. You MAY NOT share tubes or images in anyway be it via email, disk, file sharing site or any other known methods of file sharing.
7. You MAY use “close-ups”
8. You MAY animate tubes or images
9. You MAY use sparkle effects for hair, clothing, lettering, etc. and you may animate eyes for blinking.
10. You MAY NOT change any image to black and white monotone UNLESS you are making a monotone (one color) creation.
11. You MAY NOT change image to black and white and then colorize it again yourself.
12. You MAY take an EXISTING black and white image or tube and colorize it yourself
13. You MAY place small elements on images in order to “cover up” prohibited body parts. This is to allow for usage of rated R or PG-13 images in more modest groups.
14. You MAY NOT add your own embellishments such as hats, socks, shoes, stockings etc.that have not been provided as part of the original piece of artwork to you by NKDA
*Note: Exceptions are made for holiday occasions.
15. You MAY “mix” with your personal photography, with stock photography or with any other photographers or artists work as long as you have the proper permission from these artists or photographers
16. You MAY use stock photography with NKDA art in your creations
17. You MAY use your own personal photography with NKDA creations.
18.You MAY create tutorials using NKDA images however you MUST very clearly state on the tutorial page that the image you are using is for example only. Anyone wishing to use the same image in their own personal creation MUST have a membership or the allowance of NKDA. A link to www.nkdigitalart.us must be provided
19. NKDA images MAY NOT be used in ANY COMMERCIAL ENDEAVOR unless it is stated at the download page or you have our written permission BEFoRE usage.
20. You MAY create BLANK tags, stationery or web sets etc. as long as you provide a link to www.nkdigitalart.us in your creations
21. Any stationery (stats) created featuring NKDA artwork MUST contain copyright credits in two places.
1. By the actual artwork on the stat.
2. In the credits at the bottom of the stat.
22. You MAY print images, tubes or creations made from Kat and Namon's works. these are for your personal non commercial use ONLY
for any exeption of our TOU you need to contact www.nkdigitalart.us for proper permission by stating clearly for which purpose you want to use our work and if monetary gain is involved in your creations and in which way the distribution is planned.
Subscription Agreement
All subscription payments are non-refundable!
1. NKDigitalArt is a subscription service and you the subscriber
are responsible for your subscription(s).
2. You can manage your membership at the NKDigitalArt
Members Area. You have full control of your membership
information and we only request that you use the same
information that you use at paypal.This ensures that the
billing and security system can find the information it
needs to continue the subscription service or find the
cancellation notices.
3. The subscriber is responsible to report any over
payments or duplicate subsciptions to the administrator,
admin@nkdigitalart.us to prevent future billings
4. The subscriber is responsible to cancel the
subscription, the recurring subscriptions will be billed
each time they become due. If you are unsure how to
cancel your subscription, notify the administrator 7 days
in advance, so the billing can be canceled before the next
billing date. You should recieve a cancellation notice from
paypal the day the subscription is canceled, and notify the
administrator if you do not recieve the notice, because the
cancelation didn't go through paypal.
5. NKDigitalArt uses leech protection, that means if you share
your login information with anyone, it will disable your account.
The account will remain disabled, your susbcription will be cancelled,
and you will be banned from the website, no exceptions.
6. We will at no time 'sell' the tubes you find at our site. With
your membership fee you obtain the right to use our artwork and
tubes of this artwork for non commercial purposes only, as long as
not otherwise stated. Credit is required to www.nkdigitalart.us. The
copyright remains at NKDigitalArt.
7. With the membership fee you obtain the right to use our scrap kits and
elements for non commercial purposes only, as long as not otherwise stated.
Redistribution of scrap kits/elements or any other item from this site is strictly
forbidden If you want to use our artwork for commercial purposes like greeting cards
or websets - please contact admin@nkdigitalart.us for permission.
8. Filing a claim against NKDigitalArt at PayPal is in violation of this agreement.
This an automated billing system, we cannot know
when the subscriber wants to end their subscription to NKDigitalArt,
unless the subscriber sends a notice to admin@nkdigitalart.us in advance.
This means if you let PayPal bill your next subscription payment, you
file a claim against NKDigitalArt for fraud or unauthorized account activity,
this is in violation of PayPal's TOU, which can be found on thier site.
NKDigitalArt will fight any claim that is filed against us, because we did not
bill you.
